Probate is the process of gathering a person’s assets, assessing and paying creditors and making distribution to those entitled to receive the decedent’s property. If a person dies with a Will (testate), distribution is made pursuant to the Will. If a person dies without a Will (intestate), distribution is made pursuant to the state’s intestacy law. What is Summary Adminstration?

Summary Administration is a procedure available for the administration of estates under $75,000 or when the decedent has been dead for more than two years. It avoids the need to appoint a personal representative.

What is Formal Administration?

Formal administration is used for all estates when the decedent’s assets subject to probate are over $75,000, or whenever a personal representative is required.
